Terms of Use

These terms cover your use of the pulsepadel.ai website and the Pulse service. Pulse is a product of Refinr Agency FZC LLC (licence number 2626518482888), registered in Ajman NuVentures Centre Free Zone, United Arab Emirates, at BC-892837, 26th Floor, Amber Gem Tower, Ajman, United Arab Emirates (“we”, “us”).

If your club has signed a services agreement with us, that agreement and its Data Processing Agreement take priority over these terms wherever they differ. These terms fill any gaps and cover everyone else using the site.

1. Using this website

  1. You can browse the site, try the live demo bot and book a demo for free.
  2. Content on the site, including prices and results, is general information. It isn’t an offer or a contract. What we provide to a club, and at what price, is set out in that club’s signed agreement.
  3. You must not misuse the site: no attempts to hack, overload, scrape or copy it, and no use of the demo bot to send abusive, unlawful or automated messages.
  4. If you have a demo access code, keep it to yourself. We may withdraw it at any time.

2. The Pulse service

  1. Pulse gives padel and sports clubs an AI front desk on WhatsApp, a shared inbox, a player CRM, reporting, and WhatsApp campaign and community tools.
  2. Pulse works with the club’s own Playtomic account and WhatsApp Business number. The club keeps those accounts in its own name.
  3. We improve Pulse all the time, so features may change. We won’t reduce what a club is paying for without telling it.
  4. If you sign up for a club, you confirm you’re authorised to act for that club.

3. Club responsibilities

A club using Pulse agrees to:

  1. Give us accurate information about its prices, policies and opening hours, and keep it up to date.
  2. Keep its dashboard logins secure.
  3. Follow Meta’s WhatsApp Business policies and Playtomic’s terms for its own accounts. Breaking Meta’s rules can get a WhatsApp number restricted, which is outside our control.
  4. Only send marketing to players it has the right to contact, including parental consent for junior players where needed.
  5. Not resell Pulse or let another business use it without our written agreement.

4. Third-party services

Pulse relies on services we don’t control, mainly Playtomic, Meta (WhatsApp) and our hosting and AI providers. Their own terms, pricing and availability apply. We aren’t responsible for outages, changes or restrictions that come from them, but we’ll work to keep the service running and tell clubs about anything that affects them.

5. AI-generated replies

Pulse uses AI to answer messages and produce analysis. The AI only takes actions the club has approved and passes anything unusual to the club’s staff. AI can occasionally get things wrong, so the club stays responsible for its own prices, policies and decisions.

6. Fees

Fees, currency and any setup fee, guarantee or notice period are set out in the club’s signed agreement. Meta charges some WhatsApp message fees directly. We pass these on at cost and add nothing on top.

7. Data protection

How we handle personal data is explained in our Privacy Policy and Cookie Policy. For player data we handle for a club, the club is in charge of the data and we act on its instructions under a Data Processing Agreement.

8. Ownership

We own the Pulse software, the website and its content. Clubs own their data, branding and content, and let us use them only to provide the service.

9. Liability

  1. We provide the website as it is. We don’t promise it will always be available or error-free.
  2. We aren’t liable for lost profits or indirect losses.
  3. For clubs, our total liability is set out in the club’s signed agreement. If there isn’t one, it is limited to the fees the club paid us in the 12 months before the claim.
  4. Nothing in these terms limits liability that the law doesn’t allow us to limit.

10. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change materially affects clubs, we’ll tell them directly.

11. Law

These terms are governed by the laws of the United Arab Emirates. For clubs, the governing law and courts named in the club’s signed agreement apply.
